Voimar Konnector Terms of Service
A private, African-Native Web Connector app on a prepaid pass. Please read these terms - they explain what you can expect from us and what we expect from you.
1. Who we are and what this is
Voimar Konnector is an app and online service from VOIMAR (Pty) Ltd ("Voimar", "we", "us"), VAT No 4330267396, C11 Carlswald Close, Cnr New Road and 7th Road, Carlswald, Midrand, 1685, South Africa. It carries your internet traffic over an encrypted connection to Voimar's own network in South Africa and on to the internet.
These terms are a legal agreement between you and Voimar. Please read them with our Privacy Notice, which forms part of them.
2. Encryption and data storage - we are a Data Transport or Transit Layer
Voimar Konnector is a Data Transport or Transit Layer. Your traffic passes through Voimar's network encrypted and is not kept: we do not store the content of what you browse, send or receive on our servers - not your browsing, not your files, not your photos, not your calls. Chat messages follow the chat privacy protocol below.
Voimar never records calls. Konnector has no call recording, call monitoring or "listen in" feature of any kind, for anyone - including Voimar.
Chat privacy protocol: SecureChat messages, voice notes, photos and documents are end-to-end encrypted on your phone - Voimar can't read them. Voimar is only the transport layer: they pass through Voimar's own server in South Africa in memory, on their way to your contact, and are never stored on a disk or in a database. They're gone from our server the moment your contact's phone receives them; if that phone is offline, anything not received within 24 hours is dropped and your phone sends it again. Your chat history stays on your phone only, and every message disappears from both phones within 72 hours at most (a chat can choose 24, 48 or 72 hours) - for anything you need to keep, use another app. We never sell or use your messages.
Konnector adds an encrypted transport layer between your device and Voimar, and your internet traffic leaves Voimar's network routed through VOIMAR-AS in South Africa. Voimar keeps no data on this transport layer; the only records kept are call detail records (CDRs) for billing and cost accounting, and each call's quality measurements (numbers such as sound lost and delay, and your rating if you give one - never audio, never who you called) to keep calls clear.
Konnector does not secure communications inside third-party apps or services (for example WhatsApp, social media or email). Those remain subject to the provider's own security and privacy terms. SecureChat and Konnector calls are Voimar's end-to-end private channels.
Your connection between your device and Voimar is encrypted (WireGuard or IPsec). Chat and calls are end-to-end encrypted when they launch, so only the people in the conversation can read or hear them - not Voimar.
Files and photos you share are never stored on Voimar's servers. Where a file has to pass through our network to reach someone, it passes through encrypted, only for as long as it takes to deliver, and is not kept. If you delete it from your device, there is no copy with us.
What we do keep is limited to what we need to run and bill the service and what South African law requires: your account details, your devices and logins, when they connect, and how much traffic passes (totals, not content). Because we don't keep content, we cannot hand over content we don't have.
This is a deliberate design choice: your content stays with you and the people you share it with, on your devices - not in data centres abroad.
3. Accepting these terms and who may use Konnector
By creating an account, verifying your number or using Voimar Konnector you agree to these terms. If you don't agree, don't use the service.
You must be 18 or older. Children and young people under 18 may use Konnector only through a parent or legal guardian who sponsors them through Voimar Family, has confirmed their own identity, consents to the processing of the child's personal information and accepts these terms on the child's behalf, and supervises the child's use. For children under 10, strong parental controls - safe browsing (a family firewall that blocks adult content and malware), family-only chat, no paid calls and quiet hours - are always on.
Know Your Customer (KYC): Voimar provides you with telephone numbers and communication services, so South African law (including the Regulation of Interception of Communications and Provision of Communication-Related Information Act (RICA) and ICASA's regulations) requires us to identify every subscriber. You must give your South African ID number (or passport number, nationality and date of birth) within 3 days of starting to use Konnector; from age 16 an ID or passport number is required, and under 16 a date of birth. We keep your identity number encrypted, show only its last 4 digits, and use it only for legal compliance, fraud prevention and lawful requests. One identity may hold one account.
You must give true, current details, keep your mobile number and email up to date, and use one account for one person. One mobile number can belong to one account only.
If you use Konnector for a business, you confirm you are authorised to bind that business to these terms, and "you" includes that business.
4. Konnector is an over-the-top (OTT) service - your mobile network and your data
Konnector is an over-the-top (OTT) security and privacy layer. It runs on top of the internet connection you already have (for example your SIM's mobile data or Wi-Fi). Voimar is not your mobile network operator (MNO).
Your MNO provides and is responsible for your SIM, your mobile number, SIM registration under RICA, network coverage and quality, data and airtime charges, and compliance with ICASA licence conditions and regulations that apply to its mobile network services. Voimar accepts no responsibility or liability for RICA or ICASA compliance relating to MNO services, or for your MNO's charges or service.
Your MNO costs remain yours: mobile data, and phone calls and SMSs made outside the Konnector app, are billed by your MNO under its own terms - including while vKonnector is active. Konnector does not replace your mobile contract, data or airtime.
You are responsible for complying with your network provider's terms.
5. Passes, speeds, fair use and payment
Konnector Premium plans are month to month: no contract and no lock-in. Each month is paid in advance; cancel any time and your plan simply runs to the end of the month you paid for. Prices include VAT and every purchase gets a tax invoice.
From the start of your fourth month (after your first 90 days), plans include a minimum monthly commitment: Voimar airtime, which is non-refundable and can be shared with your Voimar Family, and a Voimar Private APN package. The amounts are shown before you commit, and nothing is charged for them in your first 90 days.
Heavyweight covers the account holder and up to 3 active Voimar Family members (the first three to join), for as long as the account holder's plan runs.
Speeds are "up to" the tier on your pass (for example up to 5, 10 or 20 Mbps). They are best-effort, not guaranteed: the speed you get depends on how busy the network is, your own connection and signal, and the sites you use. When the network is busy, available capacity is shared fairly between everyone online, so each person gets a fair share rather than a fixed speed.
Fair use and throttling: passes are for personal use by one person on their own devices. To keep Konnector fast and fair for everyone, Voimar may manage traffic - including slowing (throttling) or prioritising certain traffic, and limiting sustained heavy use such as continuous large downloads, file-sharing, streaming to many devices, reselling or running servers. Where someone's use repeatedly harms the service for others, we may limit their speed further, ask them to move to a suitable business service, or suspend access under section 15. Unlimited means no data cap, not unlimited speed.
Calls to other networks are billed per second at the published rates (for example R0.75 a minute to mobiles and R0.35 a minute to landlines); calls between Konnector users are free. Rates can change with notice as set out in section 16.
Passes are not refundable once bought, except where the law requires otherwise. A pass bought for someone else is held for their number until they sign up.
With Voimar Family a sponsor pays for other people's passes. The sponsor is responsible for payments they make; members keep their own accounts and can leave at any time. Auto top-up charges your chosen saved card automatically until you switch it off.
Card payments are processed by Paystack. Voimar never sees or stores your full card details.
6. Protecting children
Voimar has zero tolerance for the sexual exploitation or abuse of children. You may not use Konnector to create, share, request or access child sexual abuse material, or to contact, groom, solicit, threaten or exploit anyone under 18. Adults may not use Konnector to seek out, befriend or communicate with children they do not know for any sexual, harmful or deceptive purpose.
Where we become aware of child sexual abuse material or of a child at risk, we will act immediately - including suspending the accounts involved, preserving the records we hold, and reporting to the South African Police Service and other authorities as the law requires (including under the Films and Publications Act and the Criminal Law (Sexual Offences and Related Matters) Amendment Act).
Parents and guardians who sponsor a minor are responsible for supervising the minor's use of Konnector, for the minor's compliance with these terms, and for keeping the minor's account details accurate. Please report any concern about a child's safety to legal@voimar.co.za immediately.
7. Fraud, phishing and scams
You may not use Konnector for fraud, phishing, smishing, vishing, impersonation, identity theft, investment or romance scams, spam, or any attempt to trick people into giving money, passwords, one-time codes or personal information.
Voimar will never ask you for your password, a verification code or your card number by phone, SMS, WhatsApp, email or chat. Anyone who does is not Voimar - don't share it, and report it to legal@voimar.co.za.
You are responsible for keeping your devices, password, verification codes and account secure, and for everything done through your account. Tell us immediately if you think your account has been compromised.
Voimar is not responsible for loss you suffer because you were deceived by another person, or because you shared your password, codes or device, to the extent the law allows.
8. Acceptable use
Don't use Konnector to break the law or anyone's rights, including: malware, attacks on networks or systems, unauthorised access, harassment, hate speech that incites harm, threats, intimate images shared without consent, or infringing intellectual property.
Don't resell, share or sublicense your access, create accounts by automated means, try to bypass our security, limits or payments, or use the service in a way that harms the network or other users.
Illegal and illicit use of Voimar's network and IP systems is prohibited. You may not use Voimar's network, IP addresses, telephone numbers, servers or any Voimar system to commit, plan, hide or facilitate any offence or unlawful act - including cybercrime (such as offences under the Cybercrimes Act 19 of 2020), fraud, phishing, scams, identity theft, money laundering, extortion, spam or bulk unsolicited messages, hacking, port scanning, denial-of-service attacks, botnets or malware, child sexual abuse material, trafficking, terrorism, piracy or other intellectual property infringement, or hiding your identity or location to do any of these.
We reserve the right to block suspicious activity. Where we reasonably suspect illegal, illicit, abusive or harmful use, we may immediately and without prior notice block traffic, numbers, IP addresses, devices, messages in transit or accounts while we review it - and keep the block, limit the service or end the account after review. Blocking is a protective measure; it is not an admission or a finding against you.
Reporting and review. Anyone can report abuse from inside the app (or to legal@voimar.co.za). Voimar reviews every report through a documented process: we assess it, may temporarily block the account or content concerned, give the person a chance to respond where it is safe and lawful to do so, decide, and record the outcome. Messages are end-to-end encrypted and Voimar cannot read them; a report may include messages the reporter chooses to share.
We co-operate with law enforcement and regulators and will preserve and disclose the information we hold (which excludes the content of end-to-end encrypted messages) when the law requires it - for example under RICA, the Cybercrimes Act, the Criminal Procedure Act or a court order.
You are responsible for everything done through your account, devices and numbers. You indemnify Voimar, its directors, employees and partners against all claims, losses, fines, penalties and costs (including legal costs on an attorney-and-client scale) arising from your illegal or illicit use of Voimar's network or IP systems, or from your breach of these rules, to the extent the law allows.
We may investigate suspected breaches and suspend or end access that breaks these rules - immediately where needed to protect the network, our users (especially children) or others.
9. Other people and their content
Voimar carries traffic; it does not create, review or control the content other people send or publish, and it is not responsible for other users' conduct or content. You use Konnector and communicate with other people at your own risk, and you are responsible for the content you send.
If someone misuses Konnector against you, please report it to legal@voimar.co.za. We will act on credible reports within what we can do as a transport service.
10. Law enforcement and legal requests
Voimar complies with valid legal process under South African law, including the Regulation of Interception of Communications and Provision of Communication-Related Information Act (RICA), the Cybercrimes Act, the Electronic Communications and Transactions Act and POPIA. We can only provide the records we actually hold - account, billing and connection records - because we do not keep content.
Legal requests and notices must be sent to legal@voimar.co.za.
11. Your personal information (POPIA)
Voimar is the responsible party for the personal information we process to provide Konnector. We process it lawfully, minimally and for the purposes set out in our Privacy Notice, keep it on Voimar's own infrastructure in South Africa, and protect it with appropriate security measures.
We process a child's personal information only with the consent of a competent person (the parent or guardian sponsoring them) or as the law otherwise allows.
You can exercise your POPIA rights - access, correction, deletion, objection - by contacting privacy@voimar.co.za. Voimar's Information Officer is Zuko Leonard Rabotapi, infoofficer@voimar.co.za. You may also complain to the Information Regulator (South Africa).
12. The service is provided "as is"
We work hard to keep Konnector available and secure, but we provide it "as is" and "as available". We don't promise it will be uninterrupted, error-free, secure against every threat, or suitable for any particular purpose, and we may change, suspend or stop features.
Konnector is not for emergency calls or life-critical use.
13. Limits on our liability
To the extent the law allows, Voimar, its directors, employees and partners are not liable for indirect, consequential, special or punitive loss (such as lost profits, data, goodwill or business), for loss caused by other users, third parties, your network provider or third-party services, or for events outside our reasonable control.
To the extent the law allows, our total liability to you for all claims is limited to the amount you paid Voimar for the service in the 3 months before the claim arose.
Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be limited, or our liability for gross negligence or fraud.
14. You protect Voimar (indemnity)
To the extent the law allows, you indemnify and hold Voimar, its directors, employees and partners harmless against all claims, losses, damages, fines, costs and legal fees (on the attorney-and-own-client scale) arising from: your use or misuse of Konnector; content you send; your breach of these terms or the law; your infringement of anyone's rights; or anyone using your account.
A parent or guardian who sponsors a minor gives this indemnity for the minor's use as well.
15. Suspension and ending
You can stop using Konnector at any time. We may suspend or end your account, without refund, for breach of these terms, suspected fraud or abuse, risk to children or other users, non-payment, or where the law requires it. We will tell you where it's reasonable and lawful to do so.
16. Changes to these terms
We may update these terms. If a change is material we'll tell you in the app or by email before it applies; continuing to use Konnector after that means you accept the change.
17. Law, disputes and legal notices
These terms are governed by the law of the Republic of South Africa. Please contact us first so we can try to resolve any issue; otherwise disputes go to the courts of South Africa.
All legal notices and legal issues must be sent to legal@voimar.co.za. Voimar's chosen address for legal documents (domicilium) is C11 Carlswald Close, Cnr New Road and 7th Road, Carlswald, Midrand, 1685.
18. General
These terms and the Privacy Notice are the whole agreement between you and Voimar about Konnector. If any part is found unenforceable, the rest still applies. If we don't enforce a right immediately, we haven't given it up. You may not transfer your account or these terms; Voimar may transfer them as part of a reorganisation, merger or sale.
